Functional Analysis Correlation Request Policy for EOL Products

Below please find details pertaining to the Military & Mature Product Operations (MMPO) Functional Analysis/Correlation Request (FACR) program for End-of-Life (EOL) products.

This memo is written for the purpose of EOL FACR policy clarification.

The following policy applies to all FACRs related to MMPO EOL products. This policy is in full accordance with Intel Corporations standard Terms and Conditions of Sale. Reference item six, paragraph three, of Intel standard Terms and Conditions document.

- Post MMPO announced EOL last time product specific order date, MMPO reserves the right to not complete Functional Analysis/Correlation Requests for given End-of-Life product.

- If any EOL Product furnished by MMPO fails to conform to standard Intel warranty, MMPO's sole and exclusive liability will be, at MMPO's option, to replace or credit Buyer's account with an amount equal to the price paid for any such Product which fails during the applicable warranty period with the following provisions:

(a) Buyer promptly notifies Intel in writing that such Product is defective and furnishes an explanation of the deficiency
(b) Such Product is returned to Intel's service facility at Buyer's risk; and
(c) MMPO is satisfied that claimed deficiencies exist and were not caused by accident, misuse, neglect, alteration, repair, improper installation or improper testing.
